Countdown to Compliance: The 2022 Construction General Permit (CGP) Begins September 1st 

 The 2022 Construction General Permit (CGP) takes effect on September 1, 2023. As noted in our previous article, the 2022 CGP includes significant modifications compared to the 2009 CGP, such as: 

  • Total Maximum Daily Load (TMDL) Implementation Requirements; 
  • Construction Dewatering and Discharge Requirements;  
  • Non-Delegated Inspection Requirements for QSDs and QSPs; 
  • Revised Storm-Related Monitoring Requirements; and 
  • Single Sample Numeric Action Level (NAL) Exceedance Criteria 

 The effective date of the 2022 CGP coincides with the start of a two-year regulatory transition period. During the transition period, existing projects may continue coverage under the 2009 CGP, while new developments and new areas added to existing projects will be subject to the 2022 CGP requirements. During the regulatory transition period, it is possible that projects will have coverage under both permits. As such, contractors and developers will need to understand the requirements and applicability of both permits.
